Fly-blue.es is a website owned by CATAMARANES MALAGA. S.L., dedicated to the activity of MARITIME EXCURSIONS, hereinafter identified as Fly Blue - Great Catamaran, acts as responsible for the contents of the web page fly-blue.es and for the Commercial Policy of the Establishment.
FLY BLUE - GRAN CATAMARAN, acts as responsible for the Commercial Policy. CONTRACT BETWEEN THE PARTIES. Through the present document the General Conditions are detailed that will bind FLY BLUE - GRAN CATAMARAN and the recipient of the service provided that appears on the front, forming part of another main document dated and with a serial number. From now on, the addressee of the service, recognized as the User in the processes of commercialization of boat tickets, conditioned to the acceptance without modifications of the same one so that the legal relation between the parts takes full effect. The User declares that he has the legal capacity to be bound by this agreement, which he understands and comprehends in its entirety. The payment of complete or partial reservations by the User shall be deemed to have read, understood and accepted this contractual document.
ACQUISITION OF PRODUCTS AND SERVICES
The sale of tourist products and services to the User will be carried out only by FLY BLUE - GRAN CATAMARAN (or authorized persons and entities), which has the necessary permits and licenses for the development of the activity in the Port of Málaga. The VAT applied to the service is the general rate of 21% and the reduced rate of 10% for those operations and services that are applicable according to the VAT Law. In particular, the User accepts that he will only use the vessel for himself and that the products or services acquired through FLY BLUE - GRAN CATAMARAN will be for his own use or consumption or that of the persons on behalf of whom he is legally authorised to act. The User will be able to resell the tickets or services acquired through FLY BLUE - GRAN CATAMARAN to other persons or entities, as long as he/she has signed authorization to do so. FLY BLUE - GRAN CATAMARAN will be responsible to the User for the fulfilment of the obligations derived from the regulations in force and from the terms and conditions of sale of each of the products and services or package trips that are contracted, without FLY BLUE - GRAN CATAMARAN assuming any obligation or responsibility for those products or services that it does not provide or sell directly to the User.
SALES PROCESS
The User will pay by bank transfer the agreed percentage as part of the price of the service to guarantee the reservation. The User must have paid 100% of the service 24 hours before sailing; otherwise, the services and/or products purchased will be cancelled and the amounts paid on account or reservations will be held by FLY BLUE - GRAN CATAMARAN as compensation.
PASSENGER INFORMATION
Ticket. The FLY BLUE - GRAN CATAMARAN ticket is unique and can be transferred to another user, but when boarding with the ticket, it will not give access to other users with other copies of the ticket, so once the user has accessed the vessel, any other copy of the ticket will deny its holder access. If FLY BLUE - GRAN CATAMARAN observes that the ticket is a forgery, it may deny access to the ship. The holder of the ticket is covered by the Compulsory Passenger Insurance, FLY BLUE - GRAN CATAMARAN is not responsible for any damage caused by the negligence of the passenger or by the non compliance of the security rules indicated. You must keep the ticket to make any kind of claim or complaint.
Boarding pass. The ticket is the boarding pass itself, without which you cannot access the ship. In case of loss of the ticket FLY BLUE - GRAN CATAMARAN does not assume any responsibility for this loss, although it will try to make a duplicate with the data available to the User.
Boarding. It is important that the User respects the schedules to guarantee the service in a correct way. The User will be able to board with the ticket through the passenger accesses. Minors and babies will be able to access together with the User. If the service provided by FLY BLUE - GREAT CATAMARAN to the User is of those that require the majority of age according to the current legislation, minors and babies will not be able to access the ship accompanying the User.
Documentation. The User and accompanying persons must be in possession of ID card, passport or NIE, Family Book or any other valid documentation for the correct identification of the persons before boarding. The documents must be original and in force.
Luggage. The User or accompanying persons may not board the vessel with baggage. It will not be catalogued as luggage: handbags, plastic bags, computer cases and other similar items of daily use, being limited to 1 the number of such items per passenger. FLY BLUE - GRAN CATAMARAN and the crew of the ship, are not responsible for jewelry, jewelry, money or valuables owned by passengers. It is prohibited to introduce and carry on board goods of illegal trade and dangerous goods.
Cancellation/Modification of reservation. The cancellation or postponement by the User of reservations and tickets issued for a specific date is not allowed, so the user loses the amount of the reservation once made. In any case, if in any way a reservation can be cancelled, cancelled, postponed or modified, the amount of the new ticket to be postponed or modified, and the amount of the purchase made if it is to be cancelled or postponed, will be fixed as an expense.
Minors and pregnant women. Minors may not access the vessel if the service offered by the User is parties/events for adults. Pregnant women may access but the company may request a medical certificate authorizing them to travel after the 28th week of pregnancy. In any case, this must be communicated at the time of booking or purchase of the ticket.
Persons with reduced mobility and disabled persons. Customers with reduced mobility must communicate it at the time of booking or purchase of the ticket and must be accompanied by a companion to facilitate assistance on the trip. The personnel both on land and on board will provide assistance at all times for the smooth running of the trip. At the time of boarding, this may be before or after the rest of the passengers. Once on board the staff will indicate the most suitable place for the trip.
Pets. The boarding of any type of animals is completely forbidden, except for those for people with vision problems, in which case they must be provided with the animal's certificates prescribed by the competent Authorities. This circumstance must be communicated at the time of reservation or purchase of the ticket.
Delays in departures and/or arrivals If the service suffers any kind of delay in the departures and/or arrivals, you can claim to FLY BLUE - GRAN CATAMARAN, who will answer to your request. It is understood as a delay in the departure and/or arrival that which exceeds 15 minutes. The Captain may advance and/or delay any service due to damage to the vessel, weather forecast and/or unexpected state of the swell/wind.
Cancellation. The Captain may cancel any service due to breakdown of the vessel, weather forecast and/or unexpected wave/wind conditions, proceeding in that exclusive case to the refund of the amounts paid so far by the customer.
Replacement of the vessel. FLY BLUE - GRAN CATAMARAN may replace the vessel providing the service by another one of similar or similar characteristics in case of damage, maintenance or by legal provision. In the case of replacement of the vessel that provides the service, the User will be duly informed and will have the right to cancel the contracted service and to have the amounts delivered as a reservation returned. The User expressly renounces to claim compensation from FLY BLUE - GRAN CATAMARAN for the substitution of the vessel for any of the causes mentioned above.
PRICES. The prices are specified in full, including taxes, management fees and compulsory insurance.
MEANS OF PAYMENT
The User declares that he/she is the legitimate holder of the payment instrument and as such can legally make the purchase, under his/her sole responsibility. All payments will be made by bank transfer, credit card or Pay-Pal.
PROTECTION OF PERSONAL DATA
On the processing of personal data and without prejudice to other legal obligations in compliance with data protection provisions, personal data collected will not be processed or used for any purpose other than the purchase of the ticket, nor kept for longer than necessary. Personal data will be deleted automatically and without undue delay once the vessel's voyage has been safely completed or, as the case may be, at the end of an investigation or legal proceedings following an accident or emergency. The User also declares that all information provided by him/her for the purchase of the ticket is true, complete and accurate.
LIMITATION OF LIABILITY
FLY BLUE - GRAN CATAMARAN can offer through its sales channels commercial information and prices different from those established here, so the User accepts that what is offered by other channels is not information and/or services linked to those contracted in this document. The limitation of responsibility of FLY BLUE - GRAN CATAMARAN will be the one established by the legislation applicable to the effect and especially the regulation to the travel agencies. In any case, it cannot assume responsibility for direct or indirect damage due to loss of profit or consequential damage derived from the sale of a product or service offered, which could be caused by someone else or by the negligence of the supplier of the service or product. If due to force majeure (including, but not limited to, political or economic disorders or instability affecting security), deficiencies are derived in the reservations, confirmations and/or execution of any trips or services that are contracted through FLY BLUE - GRAN CATAMARAN, For circumstances that are not foreseeable or solvable by FLY BLUE - GRAN CATAMARAN or if it is even impossible to comply with some of the agreed services, FLY BLUE - GRAN CATAMARAN and/or the companies of the FLY BLUE - GRAN CATAMARAN group are excluded from any legal responsibility derived from these deficiencies or noncompliances, unless it is clearly stated that FLY BLUE - GRAN CATAMARAN lacks professional diligence.
